PHOTO RELEASE TERMS AND CONDITIONS

I grant permission to Wingbeat Movement Arts, its employees and agents, to record my participation using recording devices of any kind, including but not limited to photographs, digital images, drawings, renderings, voices, sounds, video recordings, audio clips or accompanying written descriptions. I agree that Wingbeat Movement Arts owns the images and all rights related to them. I waive any right to inspect or approve the finished images or any printed or electronic matter that may be used with them. The images may be used in any and all media, whether now known or hereafter devised, in perpetuity, without payment of fees, royalties, special credit or other compensation. I release Wingbeat Movement Arts and its employees and agents, including any firm authorized to publish, broadcast and/or distribute a finished product containing the images, from any claims, damages or liability which I may ever have in connection with the taking or use of the images or printed material used with the images.

LIABILITY RELEASE TERMS AND CONDITIONS

In consideration of the services and events of Wingbeat Movement Arts their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as Wingbeat), I hereby agree to release, indemnify, and discharge Wingbeat, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows.

I acknowledge that my participation in movement art training, instruction, rehearsal, and performance, including dance, yoga, trapeze, aerial arts and other disciplines entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risk include, among other things: exposing its participants to the potential for slips and falls and falling; rope burns; pinches; scrapes, twists and jolts that could result in scratches, bruises, sprains, lacerations, fractures, concussions, or even severe life threatening hazards; strains, sprains, cuts, bruises, muscle soreness and fractures; musculoskeletal injuries including head, neck, and back; injuries to internal organs; the negligence of other people; my own physical condition; and the risk of emotional and psychological injuries or physical damage associated with this activity. Traveling to and from shows, rehearsals, classes, and events raises the possibility of any manner of transportation accidents. In any event, if I or my child is injured, I or my child may require medical assistance, at my own expense.

I expressly agree and promise to accept and assume all of the risk existing in activities with Wingbeat. My participation in these activities is purely voluntary, and I elect to participate in spite of the risks. I also acknowledge and accept the risks and dangers that come with choosing to participate in activities during the COVID-19 pandemic, including exposure, illness, injury, or death. I understand that adhering to the protocols and guidelines recommended by the National Institute of Health will significantly reduce these risks.

I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Wingbeat from any and all claims, demands, or causes of action, which are in any way connected with my participation in events and services of Wingbeat, including my voluntary participation during the COVID-19 pandemic, or my use of Wingbeat’s equipment or facilities, including any such claims which allege negligent acts or omissions of Wingbeat.

I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical conditions I may have.

I acknowledge that if anyone is hurt or property is damaged during my participation in activities, services, or events hosted by Wingbeat, I may be found by a court of law to have waived my right to maintain a lawsuit against Wingbeat on the basis of any claim from which I have released them herein. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.

I am at least 18 years of age and competent to sign this release. I have read this release before signing, I understand its contents, meaning and impact, and I freely accept the terms.
